State Supreme Court Hearing On Pot Dispensaries Could Affect Pleasanton

Pleasanton is one of many cities whose dispensary ban on medical marijuana facilities will be affected by the ruling.

Whether cities such as Pleasanton can ban medical marijuana dispensaries will be the topic of a high-stakes court hearing.

On Tuesday, the California Supreme Court will hear arguments on whether communities can prohibit these marijuana facilities in light of the 1996 voter-approved law legalizing pot for medicinal uses in California.

As detailed in a San Jose Mercury News story, the hearing stems from a Southern California case where a wellness center sued to overturn Riverside's ban on marijuana dispenaries.

Pleasanton is one of 21 East Bay cities that have some sort of prohibition in place.

The other Alameda County cities with bans are Dublin, Emeryville, Fremont, Hayward, Livermore, Newark and Union City.

The Contra Costa County cities with bans are Antioch, Brentwood, Concord, Danville, Hercules, Lafayette, Moraga, Oakley, Pinole, Pittsburg and San Pablo.

Benicia in Solano County also has a prohibition on marijuana facilities.

In as much as Pot dispensaries are a problem, so are residential homes being used as Pot growing farms. These bring on a whole other set of problems. I'm concerned because of the obnoxious odor, fire safety, and vehicles coming and going at all hours of the day and night.
Pleasanton police seem to have been unwilling to shut these down and the city council is unwilling to act in passing local laws regulating where these places are located.

I could not agree more with Ron's comments on residential grow. A backyard neighbor of ours grows in excess of 15 plants at various stages of growth up to 6-7 feet in height. We are subjected to having our second story kid's bedrooms stare directly at the grow operations. I am under the impression that concord and other east bay cities have local ordinances precluding anyone from growing outdoors. The teenage son constantly brings buddies to see them and it is only a matter of time before this invites trespassers and/or our kids begin to notice the activity and start asking questions.

Get over yourselves,there's going to be lot's more legal marijuana for everybody just around the corner soon (and maybe just around your corner now) ! That's what the majority of Californians now believe is progress,so you'd better get used to it or move elsewhere (before it becomes legal there too) ! We've had to put up with the stupidity of you self-righteous prohibitionists for years,it's just too damn bad if you don't like marijuana & those who enjoy it's myriad benefits ! You can all go to hell (if there were such a place) as far as the majority of cannabis enthusiasts are concerned because payback is a bitch ! Believe me your hatred of us pales in comparison to our hatred of you & we now have the wind at our back & public opinion on our side ! Frightening,isn't it ?!?
